We are a specialist New Zealand competition law firm, dedicated to providing the highest quality competition law advice to help our clients achieve their goals.

+ Expertise

mergers + acquisitions

We help clients to navigate New Zealand’s merger regime, and to secure Commerce Commission approval for their mergers and acquisitions.

Michael is one of New Zealand’s leading competition M&A lawyers, and has worked on well over a hundred merger control matters in his career. He understands what it takes to get the deal through.

cartels

We advise businesses and individuals in Commerce Commission investigations and litigation, and help them to obtain civil leniency and criminal immunity for cartel conduct.

Michael has successfully helped numerous clients to secure leniency from the Commission. He advised on many cartel cases as the Commission’s Chief Legal Counsel, Competition, including New Zealand’s first criminal cartel prosecutions.

restrictive trade practices

We advise businesses in Commerce Commission investigations and litigation, including in relation to agreements that substantially lessen competition, resale price maintenance and restrictive land covenants.

Michael has significant experience in this area, including the first litigation resulting in penalties for a restrictive land covenant under section 28 of the Commerce Act.

misuse of market power

We help businesses to comply with New Zealand’s misuse of market power laws, and advise them in Commerce Commission investigations and litigation.

The law in this area has recently changed, and Michael was on the front line at the Commission as these changes bedded in. He was involved in the first investigations and in the drafting of the Commission’s Misuse of Market Power Guidelines.

competitor collaborations and other business arrangements

We help businesses to minimise competition law risk when engaging with competitors, suppliers and customers, including by securing Commerce Commission approval.

Michael has significant experience advising in this area, including joint ventures, franchise agreements, supply agreements, restraints of trade, intellectual property, licensing agreements and more.

market studies

We advise clients in relation to Commerce Commision market studies, and help them to formulate strategy and advocate their position.

Michael has worked on several market studies, in New Zealand and overseas.

Michael’s knowledge of competition law and strategy is second to none. He can always be relied upon for clear, pragmatic advice.
